US State Privacy Notice

This notice is for residents of US states with consumer privacy laws — California, Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana and others as they take effect. It describes the personal information we handle and the rights you can exercise, and supplements our Privacy Policy.

Several of these laws apply only to companies above certain revenue or volume thresholds, and ForkPoint Ltd. is below them. We give this notice and honour the rights in it anyway, for every US resident, whether or not a law compels it.

We do not sell or share your personal information

We do not sell personal information, and we do not share it for cross-context behavioural advertising, as those terms are defined in California law. We have not done so in the preceding 12 months, including for anyone we know to be under 16. We run no advertising pixels, no ad networks and no profiling that produces legal or similarly significant effects.

What we collect and why

Categories are named as US state laws name them, so you can compare this notice against others.

• Identifiers — name, email address, account identifier. Collected from you when you create an account, buy a subscription, subscribe to the newsletter or contact support. Used to provide the account, to reply to you, and to send the emails you asked for.
• Commercial information — the plan you bought, seat count, invoices, refunds. Collected when you subscribe. Used to bill you, to keep tax records, and to answer billing questions.
• Internet or network activity — technical information your browser sends when it requests a page or when the extension checks for updates. Used to keep the service running and to diagnose faults.
• Payment information — handled by our payment processor. Card numbers never reach our systems; we receive a token, the last four digits, the card brand and the billing country.

We do not collect sensitive personal information, biometric data, precise geolocation, or information about your race, health, religion, sexual orientation or union membership. We do not knowingly collect information from anyone under 18.

Who we disclose it to

Only to service providers acting on our instructions and bound to use it for nothing else: our payment processor, our email and hosting providers, and — if it ever came to it — our accountants and lawyers, or an authority acting under a valid legal request. A current list is available on request. We do not disclose personal information to anyone for their own purposes.

How long we keep it

Account and support records: for as long as the account exists, then up to 12 months. Billing and tax records: as long as tax law requires us to keep them, currently several years. Newsletter subscriptions: until you unsubscribe. Technical logs: short-lived, measured in weeks rather than years.

Your rights

• Know and access — what we hold about you, and a copy of it.
• Delete — subject to what we must keep for tax and legal reasons.
• Correct — anything inaccurate.
• Portability — your data in a portable, machine-readable format.
• Opt out of sale, sharing, or targeted advertising — there is nothing to opt out of, because we do none of these. If that ever changes, this page will carry the mechanism to opt out before it does.
• Non-discrimination — using any of these rights will never get you a worse price, a worse product or slower support.

How to exercise them

Email privacy@forkpoint.com and say what you want. We respond within 45 days, and will tell you if we need a single extension of another 45 days. There is no charge.

We verify requests by matching them against the email address on the account, and may ask one or two questions only you would be able to answer. If we cannot verify you, we will say so rather than hand your data to somebody else.

An authorised agent may act for you if you give them written permission and we can confirm it with you directly.

Appeals

If we refuse a request, we will explain why. You can appeal by replying to that answer; a different person reviews it and responds within 45 days. If the appeal is also refused, you may complain to your state Attorney General.

California Shine the Light

California residents may ask whether we disclosed personal information to third parties for their own direct marketing purposes in the previous calendar year. We did not, and do not.
