ForkPoint Ltd. (“us”, “we”, or “our”) operates the DWithEase extension for Google Chrome, Microsoft Edge, and Mozilla Firefox web browsers (the “Application”).

This page informs you of our policies regarding the collection, use, and disclosure of personal data when you use our Application and the choices you have associated with that data.

We do not use your data to provide and improve the Application. By using the DWithEase extension for Google Chrome, Microsoft Edge, Mozilla Firefox, or Chromium-based browsers, you consent to this privacy policy, and you agree to the use of information in accordance with this policy. Unless otherwise defined in this Privacy Policy, terms used in this Privacy Policy have the same meanings as in our Terms and Conditions.

Payments

We may provide paid products and/or services within the Service. In that case, we use third-party services for payment processing (e.g. payment processors).

We will not store or collect your payment card details. That information is provided directly to our third-party payment processors whose use of your personal information is governed by their Privacy Policy. These payment processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover. ForkPoint provision of this extension is provided on an “as is” and “as available” basis, to provide job matches to you and help users increase response rate and therefore disclaims any and all liability or responsibility for the accuracy, completeness, reliability, content, suitability, legality or availability of the information displayed or linked from the DWithEase extension (inclusive of job listings). With respect to your use of this extension, ForkPoint and its Affiliates and its third party licensor hereby, expressly disclaims any responsibility or liability for the accuracy, content, completeness or reliability of information provided by ForkPoint for informational purposes only, including but not limited to Analytics data like estimated applies or organic traffic, and salary information. We disclaim any responsibility for the deletion, failure to store, mis-delivery, or untimely delivery of any information, emails, attachments or material (including User Content).

 

Limitation of liability


FORKPOINT SHALL IN NO EVENT BE RESPONSIBLE OR LIABLE TO YOU OR TO ANY THIRD PARTY, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, LIQUIDATED OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFIT, REVENUE OR BUSINESS, ARISING IN WHOLE OR IN PART FROM YOUR ACCESS TO THE SERVICE, YOUR USE OF THE SERVICE OR THIS AGREEMENT, OR FOR ANY LOSS OR DAMAGE CAUSED BY YOUR RELIANCE ON IN
FORMATION OBTAINED ON OR THROUGH THE EXTENSION, EVEN IF FORKPOINT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY IN THIS AGREEMENT, FORKPOINT’S LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO 100.00 EUR (ONE HUNDRED EURO).

 

BECAUSE SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR THE LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, IN SUCH JURISDICTIONS, THE LIABILITY OF FORKPOINT SHALL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW. THEREFORE, THE FOREGOING LIMITATIONS SHALL APPLY TO THE MAXIMUM EXTENT PERMITTED BY LAW. NOTHING IN THIS AGREEMENT AFFECTS STATUTORY RIGHTS THAT CANNOT BE WAIVED OR LIMITED BY CONTRACT.

 

Indemnification


You agree to defend, indemnify and hold harmless ForkPoint from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) arising from: (a) your violation of any term of this Agreement; (b) your use of, and access to, DWithEase extension; (c) your loss of, or disclosure of, information gained from using DWithEase extension; (d) your violation of any applicable laws or regulations, any applicable employment, equality, or discrimination laws, and any applicable data protection or privacy laws; (e) your violation of any third party right, including without limitation any copyright, property, or privacy right; (f) any claim that your content caused damage to a third party; or (g) your actions as an Employer, including without limitation doing or not doing the following: screening, hiring, promoting, or demoting any employee or Candidate. You also agree that you have a duty to defend ForkPoint against such claims. You agree that this indemnity extends to requiring you to pay for ForkPoint’s reasonable attorneys’ fees, court costs, settlements, and disbursements. This defense and indemnification obligation will survive this Agreement and your use of the DWithEase extension.

 

Children’s Privacy


Our Service does not address anyone under the age of 18 (“Children”).

We do not knowingly collect personally identifiable information from anyone under the age of 18. If you are a parent or guardian and you are aware that your Children has provided us with Personal Data, please contact us. If we become aware that we have collected Personal Data from children without verification of parental consent, we will take steps to remove that information from our servers.

 

Changes To This Privacy Policy


We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page.
